" Upon resolution of the remaining fourth cause of action, a judgment shall be issued in favor of the District, and against the City, and a peremptory writ shall issue commanding the City to take action specially enjoined by law in accordance with the Court’s ruling, but nothing in the writ shall limit or control in any way the discretion legally vested in the City. The City shall make and file a return within 60 days after issuance of the writ, setting forth what has been done to comply therewith. "

It does appear that if the city can find the water to fix their EIR, their is hope that Sage could go forward in some form. 
I am less certain what "discretion" the city has that is "legally vested", but maybe they could wrangle something?

It's basically saying it's up to the City's legal discretion as to how they enforce the court's ruling. But within 60 days they have to show that they have complied with the court's verdict. There is currently no "well maybe" the City can do something. The judge has ruled, GRB could appeal but in the interim the approvals have to be pulled. An appeal will take a long ...more
