RE:Where is the ambiguity?The Kyrgyz do own JSC, just not the Centerra shares directly. If the JSC shares were under the jurisdiction of the Canadian courts, Stabs could take levy upon them (assuming a valid arbitration award which the Canadian courts have to date no accepted and are highly unlikely to ever accept the MCCI award),but since they are not - no remedy.
As I have been trying to explain to people on this board, Stans got cute and tried to force arbitration in Russia outside of UNICITRAL - a now discredited idea. Stans is going to have to go through the UNICITRAL process which is likely to be resolved before it can sieze any assets. As it stands, the Kyrgyzaltyn will likely only be relevant if Stans ultimately prevails in the new arbitration proceeding. You can complain about the recent ruling but even if it were the opposite Stans still would be unable to presently seize of freeze any Centerra shares.
