H. BC Hydro advised that it does not intend to award Energy Purchase Agreements ("EPAs") to Clean Power Call proponents until it is confident that the resulting EPAs are cost-effective and that it does not expect to be in a position to award these EPAs prior to December 31, 2009; and

I. BC Hydro advised that without the relief requested in the Application, it will be required by Section 4.10 of the CEAP Procedures to select the successful Clean Power Call participants and submit an application to BCTC to nominate those successful projects as network resources on or before December 31, 2009 or the CEAP Interconnection Requests will be deemed to be withdrawn; and

J. The relief requested in the Application will allow BC Hydro, for the Clean Power Call only, to delay its nomination of the successful projects until on or before March 31, 2010 so that BC Hydro can stage the EPA award process and provide an opportunity for remaining proponents to make more cost-effective proposals for the Clean Power Call projects;
