Perhaps we are seeing evidence of "selective enforcement" which can also fall under an arbitrary and capricious "as applied" status vis a vis the council and company.
The 45 decibel rule (once again, distance is a key) is something that is done in areas where they want to be able to cite almost anyone at anytime if they "choose" to. Noise rules on motorcycles and mowers come to mind.
