Inclined to agree with your first point and disagree with the second. 

Fortress Paper were forced to improve an offer for their debentures a couple of months ago - despite Chad's crafty consent fees etc.  Polar Asset Management had enough to hold them over a barrel.

Kudos to Hansen for acting pre-emptively and trying to do what is best for his beleagured share holders.  It buys him time to modify the deal.

Anyone buying more debs??
