I guess the moral of that document is, don't rely on the Markman Hearing alone for an investment decision, lol.

Yeah, I wouldn't focus on the Markman Hearing at present, instead look towards the potential of the current commercialization strategy, the Global Partners, and of course CERN.

These are tangibles, whereas the patent dispute will be gravy, when it's over, and we don't know that yet.  It should be a pleasant surprise, IMO, when it happens.
