I think CUS has an uphill battle. Based on their press release they would need to prove that SPB had other courses of action than litigation to work towards the merger and that SPB wasn't

It looks like Canexus is going to try and get the $25 million termination fee after all. See recenet news releae on their site.

Interesting. It was CUS that refused to extend the deadline. SPB wanted the extension. Perhaps this has bought CUS enough time to pay down some debt and be able to continue as a going concern
