Look's current licences expire before this date and since Look is supposedly winding down it's existing business, and thus usage of the spectrum, wouldn't IC's granting of a renewed license constitute giving an entity a license to sit on spectrum without using it -- if I'm not mistaken, wouldn't this be denied based on the "non-usage" breach? Something is definitely strange here, and if it weren't for the volume and buying interest since the court approval, I'd likely be long gone. I've held this dead dog for too long, but I am quite happy to be close to break even though.
The other thing that isn't adding up is in Look's submission to the IC consultation for BRS transition. I've only looked at it quickly, but my impression is that Look is asking IC to grant them 5 new BRS licenses for different geographical areas -- wouldn't this in itself nullify the sales agreement with Inukshuk for 92 MHz of MDS spectrum for 1 geographical area. I'm not very good at legalese, and I generally don't have the patience to try either.
The other thing that my mind has been toying with is that the whole sales process was a cover so that all litigation settlements could be negotiated between Look and Bell/Rogers. Is it possible that IC forced them to the table, especially if UBS's claim against Inukshuk had merit. And by forcing to the table, I mean that maybe IC gave the incumbants the heads up that they do this, and save face or risk facing UBS in court when they had the money to do so after a sale or partnership of their spectrum with a new entrant or foreigner.
Or perhaps, the optics of it all, are exactly as they seem and this deal is signed, sealed, and delivered.
But, then there's the volume and the buying interest................I'll give it a little longer to see what transpires, and if things start to get clearer.
