RE: US needs to protect IPAnschutz ... Intel doesn't have access to influential US Corridors of Power at all. Are you not aware that the New York Attorney General has initiated and Anti Trust lawsuit against Intel. Intel is in big DoDo in the US as well as abroad.
I am sure that the optics as to fairness on US vs whomever will always be at question and of concern to IP holders . The citizens / jurists of Texas are especially sensitive to property rights and continually award heavy treble damages to those in the wrong. I have faith that the venue is the correct one and that our cause is just and that we shall prevail.
Dell has no argument as well as many others as to wether they were infringing or not. Dell had written a White Paper crediting Wi-LAN with the development of the standard many years ago. It's a little late to say " we didn't know". Treble damages and possibly permanent injunction for willful infringement will be awarded imho.
The " Alleged " patent rustlers have been rounded up corralled and are awaiting trial. I think Wi-LAN is not going to accept anything less than FRAND rates pre trial. They will have many examples of what rates are fair and that they have been offered but defendants chose to ignore.
