The bar isn't all that high though. All you need is a reasonable argument that the trial judge made an error. Lawyers can easily find that argument, especially in a case like this which involves thousands of documents and laws going back hundreds of years. And is it a never-ending circle? It pretty much can be as long as Vineland is willing to pay the legal costs. So far they've shown they're willing to absorb that cost, having dragged this out for as long as they have. I wouldn't hold my breath that this gets resolved anytime soon, unless one or the other party is willing to give up, finally.
