Walk Away if they want more.Let someone else pay for MSD's tired portfolio. The only reason that it is worth $38.00 to WIN is because we have the ability to monetize it and the synergies between the two companies is very good. In order for it to make sense to anyone else, they can bid higher, but cannnot hope to gain much of a return on the iinvestment in my view.
We are far better off to beat the bushes and gain Gladios Clients and buy patents outright.
Besides who says the MSd lawsuits will be wins. At least, I have not seen any expert reports who have given legal opinions on the MSD court battles, the way we did when WIN fought their big battle in Marshall.
If WIN was calling the shots of the litigation instead of MSD, I would say they would have a better chance to resolve the suits before trial. The last major battle that MSD won in court was when Skip was the legal brains behind them.
If we are to offer more, it must be in the form of an acceptable counter offer from MSD. I for one, will not encourage another offer in the face any pronouncement from MSD that is does not contain a figure.
i.e. we do not bid against ourselves.
Right now, we are the only game in town in the face of this market. Does MSD know or have any idea where their share price would be without WIN's offer. Probably somewhere south of $30.00,
