The patent re examination doesn't preclude the fact that the patents are valid and enforceable at this time. The Judge may be waiting for the results of the re examination and I'm ok with that as it's only a few months away. If the results were a year away it would be unacceptable to wait. His decision to move forward should not be hindered on a future decision by the USPTO. It should be based on the validity and enforceability at hand at this given time inho. If I were the judge I would be secretly loading up on WIN . What a tempting proposition that would be eh. being able to affect the SP with your decision that only you can make and when you want to make it.  I'm certain it goes on. They aren't squeeky clean from my understanding.
