I have to disagree with you totally my friend on that point (Unless I am misunderstanding what you are saying). Even if a company was going out of business and all they had free and clear was the photocopier then the courts would award that to the debtholders. The company can not toss the debtholders and keep the company for themselves. It has never happened and there is no law to support such a thing. Yes, the company can start anew but with the debtholders owning the company...Now that has been done to death.

 

There is no need to go any further than the DEXO story.  Failed offer (CBCA equivalent) which moved it to Chapter 11 (CCAA equivalent). The courts gave 100% of the company to the debtholders for partial debt reduction...and life goes on.
