New regulations streamline environmental studies in mining

Except some cases, the approval of the vast majority of environmental studies miners who are being tested in the Department of Mining Environmental Affairs (DGAAM) MEM is within legal limits, said its director, Manuel Castro.

The approval of the commencement of operations of a project is the responsibility of the Directorate General of Mines.
To contribute to speeding up the evaluation and approval of environmental studies mining jurisdiction, ie, for large mining, except in Lima where also assesses environmental studies of the small mining, DGAAM take some measures.

The first, and most important, is the development of new environmental regulations for mining activities, concluded after a review of the former, which has more than 20 years.

The second step is to draft the terms of reference, so that any investment project that wants to start mining has clear parameters before being submitted. "That is going to ensure that we do not present any type of document," said Castro.

The third instrument is the Environmental Assessment System Line (SEAL), which will also reduce delays.

Of these three measures, only the first requires a supreme decree to be approved and published in the next 30 days.

It will take another 30 days to conclude the terms of reference for environmental studies and then made a selection process to develop the SEAL, virtual system to be ready in April.
Thus, Castro said that in early autumn will launch these three instruments, which the deadlines for assessment must be accelerated, to the extent that the opinions of others binding also be expedited, he said.

However, Castro warned that should preserve the quality of environmental studies. "We are in a process to try to reduce delays, but always maintaining a prudent and sufficient to ensure the quality of the assessment of environmental impact studies," he said.

Deadlines
While the System of Environmental Impact Assessment (SEIA) reports within 120 days, according to the current rule, which corresponds to the 1993 regulations, the DGAAM account with up to 250 calendar days to evaluate the detailed environmental impact studies ( EIAD), which are those that correspond to the operational phase of the projects, and lower limits for other types of studies (see chart).

Delays in the ANA
According DGAAM, another source of delay is the time delay for opinion of the National Water Authority (ANA).
The standard sets a deadline of 50 working days, but to date extends to more than 200 calendar days. There are 65 studies pending review of ANA since February 2011 (case EIA projects and Payancata Sipan).
These delays are due in large part to the lack of budget and equipment that allow the ANA issued its opinion in due course. To solve this problem, the ANA will enter the Online Assessment System or virtual (SEAL) of DGAAM, refers Castro.
The same applies to the National Service of Protected Natural Areas (Sernanp), which has eight studies awaiting review since January 2012. In this case, to establish uniform criteria around certificate holders compatibility.

Until January 10, the assessment takes 219 DGAAM environmental impact studies (see table), of which the new impact studies in detail (EIAD), which are those that require a large investment, are 27, while 96 correspond to studies posed modifications and only eight of these are extensions of projects that bring new investment.

The EIA projects remaining for modifications (88) suggest changes in the Environmental Management Plan (monitoring), which reflects the provisions of the current regulations and that is an update of the study, which seeks to ensure that the impacts environmental are lower. But do not mean stop the project or investment, according to Castro.
In these latter cases are, for example, the Comprehensive (56) through which mineral must reduce contamination permissible limits.

Exploration
The attached table shows that in other studies on the evaluation are DGAAM corresponding to the scanning, and which differ in the number of platforms or dimension that is underground mine.
In studies exploring category 1 (DIA) are few in assessment since approval is almost automatic, while in Category 2 (EIAsd) while there are 18 studios and 12 new modifications, is enhanced with the system online environmental assessment (SEAL, see box).

THE DATA
Closures. The DGAAM also evaluates mine closure plans required by law (do not draw much investment) and whose objective is not to generate environmental liabilities.

DETAILS
Admissibility. The problems at this stage are incomplete requirements to submit the studies, continuous information, the studies do not meet sectoral regulations, etcetera.
Participation. The publication is not made on time, do not arrive or are incomplete charges and the hearings are rescheduled.
Public Hearing. Sometimes the hearing is canceled or rescheduled, the contributions come until the last day and many institutions requesting special reports.
Assessment study. On more than one occasion persist observations; requested additional time, information, etc.

Virtual Assessment
Enlargement. The Environmental Assessment System Line (SEAL) having the DGAAM allows virtual evaluation. As recorded file documents or environmental studies, the system warns if any record, that detects what is missing or wrong.
This instrument is currently applied to studies of exploration and this year the goal is also to apply to the evaluation of the environmental studies for the exploitation phase.

More than 4,500 environmental studies evaluated the DGAAM in 20 years, which shows the experience and it explains what it is now coming to online assessment systems (virtual).
