A giant big KAT fight** UPDATE ** On Sept 19, in my Blog (https://seekingalpha.com/instablog/31295425-kvn/5043562-huge-undervalued-opportunity-minority-shareholders-independent-directors-take-glencore-plc?v=1505833638), I recommended anyone really interested in understanding the DRC & Glencore, do their own further due dilly and Google "Dan Gertler", "Och-Ziff DRC Scandal" and the "Fleurette Group". To think KAT's Independent Directors have put our entire Company into this lock-down PR vacuum solely because they might (only be) checking a few $numbers (financials) maybe connected to the WOL plant commissioning IS HEAD IN THE SAND WISHFUL THINKING. This excellent new piece linked below offers rare, and I believe, much better, and fulsome, insight into how, exactly, it was that Glencore ended up with KAT. https://panamapapers.investigativecenters.org/drc-copper-mining/ The Board at Glencore, it is my opinion, have had a massive problem on their hands for quite some time - especially once the US Feds linked Och-Ziff to Gertler and Gertler to Glencore. As is well known, much had to change in Corporate Culture at Glencore after that company's IPO and becoming Public. It is now open to much higher scrutiny and oversight, and is basically responsible to the large London Pension Funds and Bank clients placed at the IPO and hugely dilutionary Rights Offering. So I challenge, its past allegedly shady dealings are now clearly in the spotlight. The KAT assets have not been impaired. The Resource valuations have not been impaired. In point of fact, they would have risen strongly this past year. So what's the issue for us Minority Shareholders? The question that remains a major concern is one of Legal Ownership. Who (really) owns KAT's assets? This should ring alarm bells. Expropriation happens in Mining all over the world and it happens in DRC too. Look at First Quantum when Gcamines revoked a contract with them for a joint venture in the Kingamyambo Musonoi Tailings SARL (KMT) copper project. Up to that time, FM had spent around $750 million re-developing a copper retreatment plant at KMT.Big investment dollars in African terms. Then effectively, the DRC government steals KMT back, and "sells" it to someone else, to "new investors", namely The Highwinds Group. It is reported that Highwinds paid $60 million for those KMT assets that someone else already owned as a "signature bonus" and guess what? Who owned Highwinds? Glencore's #1 DRC guy: Dan Gertler. All was not lost for FM and in 2012 there was some justice when Fasken Martineau, a Toronto law firm, recovered $1.25 billion for FM in the case ofFirst Quantum vs Highwinds and Others. So it is not a stretch to ask if KAT's assets are actually theirs? Are they legally owned? Who exactly is the rightful owner? And if it is legally proven that Glencore can retain control, how is it they will compensate us Minority Shareholders? I still believe Glencore will take us out (takeover) and I also believe that Glencore will make several large payments in "settlement" and "fines" before this is done. Glencore is NOT going to give up these assets easily or quickly... These are my views only. Thanks for reading. I am Long KAT.
