Any of the underwriters can file suit IF indeed they think they have been defamed.  It is VERY easy to find colleagues and other people who would say "I know you were involved in the transaction and I thought Ben was referring to you.  I am disappointed in you upon hearing his allegations".  There you have it.  Basis for lawsuit against Ben and Maricann.  Whether such action will succeed or not is a different question.
