I honestly don't know if it would be legal for either party to keep such an agreement secret, but I'm guessing that that would probably be OK. But maybe not.
In any case, to be worth its salt, a prior agreement would have to name a specific price, and I doubt either party would have been willing to agree to a price that far ahead of time. Without a specific price, they have only agreed to negotiate, which could come to nothing.
So, IMO, it makes no sense, especially for DeBeers, to come to a prior agreement. Thus, again IMO, there is not an agreement and DeBeers HAS to bid at first chance, IF THEY WANT WHAT MPVD HAS.
I'm betting that there is no prior agreement, I don't think it's even a possibility.
