RE:Mining Council and OEFAYeah, both are in the list. Management got the exploration permits from the communities (Chacaconiza, Quelcaya), but not from the authorities (OEFA, MINEM and other entities). If claims are lapsed no authority would indeed grant any permit, but in this regard all we can do is wait for Mining Council's decision.
Regarding OEFA fines, they can be high but only if some "aggravating factors" are present (1), like:
- serious damage to water, soil, flora, fauna or air
- irreversibility of the damage
- a protected natural area is affected
- natives communities are seriously affected
- people's health is seriously affected
- economic damage that meaningfully increases poverty
The fine is also proportional to the illicit profit obtained by the infractor and inversely proportional to the probability of detection.
The avergae fine imposed by OEFA in the last years has been about U$70,000 (2). Seeing the above listed factors, you can see the low seriousness of Macusani Yellocake's infraction, so I think the fine will be less than said average.
You can follow OEFA's interventions and supervisions to Macusani Yellocake in its interactive portal (3). Up to now its shows 4 interventions and 2 administrative resolutions, but still no fine imposed.
