BACKGROUND
"Sin Fronteras" read the document presented where it is stated that on October 29th, 2010, by resolution N° 15-2012, the requirement of "restricted appearance" against Walter Aduviri Calisaya and others was declared founded, providing for restriction measures that the accused must comply with, like the obligation not to be absent from the place of his domicile and appear monthly and mandatory within the first three days of each month to the court's office to account for his activities. These restrictive measures were not complied with by the accused.
Aduviri during the years 2018 and 2019 did not request permission to leave the region; it is of public knowledge his travels to the city of La Paz - Bolivia to meet with the president of that country, Evo Morales.
The former Aymara leader did not sign the monthly appearance book for the months of March to December 2016, February 2017, January to December 2018 and January to March 2019. Moreover, from the report of coercive measures recorded in The Superior Court of Justice of Puno, it's clear Aduviri does not have a fingerprint registration in the registration and biometric control of those accused and sentenced.
PREVIOUS ESCAPES
On July 18th, 2017, a conviction was issued to Walter Aduviri for the crime of disturbances and he was sentenced to 7 years of effective imprisonment, which was confirmed by the Criminal Appeals Chamber on 29th December 2017; however, he did not present for the fulfillment of the judicial mandate in force at that time, going into hiding for the period of approximately nine months, which specifically allows verifying that if it is sentenced again it is very likely he will escape again, condition to vary the "restricted appearance".
PRISON IS FAIR
This media spoke with a legal analyst, who pointed out that the requirements for pretrial detention are met; for example, the penalty for the crime of disturbances charged to Aduviri is not less than 6 years. The danger of escape exists because it has previously escaped and thus he violated the rules. In addition, he failed to comply with the rules of conduct and also was in danger of obstructing the investigation of the truth, since the manipulation and threats to the witnesses, the participation of Aduviri's workers and even a provider during the trial were evidenced.
