Here is a interesting question passed along to me by a former Verde shareholder who continues to watch the Company and read the postings on this Board.
Given the excellent work sponsored by and undertaken by Verde in the agri-technology arena, we have and/or can expect to have produced significant intelectual property (IP) that will be protected by the securing of appropriate patents in all applicable jurisdictions. I will add the following questions related to this issue to the list being submitted to the Comapny for inclusion at the April 7th Q&A session. Given Mr. Veloso (CEO and Board Chiar) and Mr. Gomes (Chair of the Audit Committee, Chair of the Compensation Committee, Chair of the Nominating Committee but not the former Chairman of the Board) are both fully qualified and licenced lawyers, I have to assume this area of responsibility is well looked after.
- How many patents has Verde applied for to date and in which jurisdictions?
- What do these applications cover?
- How many patents have been granted to date and in which jurisdictions?
- What do these patents cover?
- Can you please provide the patent numbers for all patents granted?
- In whose name are the patent applications submitted? Are these held under the Verde Agritech plc name or by the 100% owned Brazilian subsidiaries, or perhaps under both?
- Are the terms and conditions of employment at Verde and its subsidiaries clear that any and all IP generated by a person while employed by the Company (and its subsidiaries) remains the property of the Comapny and not the employee?
- Are the terms and conditions of any contracted research projects sponsored by Verde and its subsidiaries clear that any and all IP generated under the contract with the Company (and its subsidiaries) remains the absolute property of the Company and not the contractor or individuals employed or retained by the contractor?
- What steps, if any, has the Company taken to protect any IP for which a patent has been granted, or against a patent application already in progress?
