So Affinor (Nick) has a lease agreement with the landowner, Nick, to build and operate the Affinor greenhouse operation. In 2022, Affinor greenhouse produced one strawberry crop to satisfy the ALR regs for land tax benefits. According to the previous financial reports, Nick received income from Affinor as well as the benefit of Affinor building the greenouse system. Unless the greenhouse system hasn't been paid for, and the equipment suppliers retrieve their equipment, it will go with the sale of the property. Nick, as the property owner, will realize the improved value of the farm. Highly doubt that Nick the land owner will sue Affinor Nick.
Any prospective buyer shoud determine of there are any liens against the property. Curiously, the real estate listing of the farm does not show or refer to the Affinor greenhouse in any way. Some of the photos in the listing appear to be several years old. What is the status of the greenhouse? Is it still operational? Or is it just a big unheated tent?
