The fact of the matter is that when deals like this are negotiated there are many people who are "in the know". This ranges from people in the various lawyers offices to staff at the companies who are drafting up the agreement. So most of the time, select few get advance knowledge of the deal and then act accordingly which could involve shorting the stock.
The rules for shorting in Canada are not very strict compared to the US but in the case of a large cap like ENB and a deal involving a US company, even the strict rules in the US regarding shorting don't have any impact in terms of preventing the activity.
