RE:Another nail in the coffinFriday is the first case management conference related to the fourth cause of action against the City.
I also found this statement in Claudia's article interesting related to court costs.
"On July 5, the water district filed a memorandum of costs, and on July 18, the parties submitted a stipulation regarding the deadlines for any motions regarding costs."
The Water District is requesting their fees to be paid because they won the case but more importantly two weeks later the City and Greenbriar were trying to have a deadline imposed for future ligation costs.
"In his order on July 23, the judge declined to accept the stipulation because the memorandum of costs was prematurely filed. He said the court will not hear any contested matters related to costs or fees until the entire action is resolved."
The judge is well aware (as is The City and Greenbriar) that this is by no means the end and could drag on in court for some time.
I'm surprised nobody is standing up at City Council meetings and asking for an update as to where the litigation is going. How much money are tax payers currently on the hook for the City and District costs, along with the project costs going forward.
Hopefully leveler heads prevail and they can come to a resolution and settle out of court.
The City will have to cover the District's cost but are shareholders on the hook for Greenbriar's costs?
Knowing Jeff he will likely sue the City.
Perhaps this is the anticipated litigation Council is discussing in their closed door sessions.
