We can probably count on 49-ish Democratic Senators voting to legalize. One or two moderate senators may vote against. Support seems strong in the party otherwise especially for the social justice aspects of previously proposed legislation.
After that these Republican Senators have made positive comments about legalization of Marijuana in the past.
Don Young - Alaska
Lisa Murkowski - Alaska
Bill Cassidy - Lousiana
Steve Daines - Montana
Rand Paul - Kentucky
That gets us to 54-55.
South Dakota has legalized so those are 2 more potential senators but that's not a given. After that, a number of other states may legalize soon and that might give us a couple more senators. Most states that have legalized or are going to have democratic senators.
If it isn't part of a Covid bill that's passed as budget reconciliation (we would only need 50+1 senators for that), we need 60 senators to pass legislation and we are currently short under the most optomistic of scenarios.
Legalizing something as contentious (at least for conservative americans) as marijuana needs a clear strategy and can't be rushed. If it's not well thought out, when the balance of power flips, legislation will be repealled on the grounds of morality or some other nonsense. That would seriously affect our stock price.
Schumer has some bridge building to do.
