(ii) Misleading and/or incorrect statements made by Ors throughout 2021 and specifically in association with the negotiation of a substantial investment from the Investors by private placement in July of 2021 to the effect that:
 
i) it was “guaranteed that we will have success with Lymphoma”, 
 
ii) that the scientific risk of the platform was “gone” and “off the table”,
 
iii) that IMV was producing the “best results in the world” from a clinical perspective and finally 
 
iv) that IMV would trade at a valuation of between $250 and $300 
per share;

Breakthrough,have you contacted the SEC or other legal authorities who could take action against the last BOD. I have appreciated the information you have provided in your posts to this board.I don't want to diminish their value in reminding investors who read your posts,but posting on this board is very unlikely to stimulate the authorities to act.

This late thing comes from a claim already presented. You can read the details (including the names of claimants, among them Thom Clalandra), in last BD affidavit.  I think they will continue till the legal end. And yes, I contacted the SEC a couple of months ago and sent them information. No idea about what do they think.

Yes, you can. Reach the Affidavit of Brittany Davison sworn on September 22 at the FTI page. The court has to take a decision about it -it will probably release the D&O.
