Let the proceedings begin.

If everyone in government knew (from the start) that the land that NDM acquired from the state (that was zoned for mining)  was never going to be allowed to be mined - then it looks like NDM has cause to sue the sate and the federal government for all money spent + time + damages.  Let the proceedings begin.

In a sense what you describe is a compensatory takings action. However, there is one current major flaw to the action.   If the negative ROD stands, and the area is not withdrawn for mineral development by the State, the proponent still has the option of reinitiating USACE 404 permitting with a new plan application submittal.  Essentially, the door remains open for development, so no ...more

NDM will never stop re-applying for the permit – each one being a little bit smaller than the one before - each one being a little less polluting then the one before  - no matter what NDM proposes, the EPA will not accept it - if the EPA will not accept any proposal for any mine in the Bristol Bay Area, then the land in question should never have been zoned for mining, it should not have been ...more

Not sold. Not own. State mineral land by acquiring or staking.   Similar to US federal mineral claims.
