Asset ownership

Strelioff has stated that YNG already owns all of the underlying assets of TlG. Where do we look to confirm that suggestion ?

Under the US legal system if this situation existed , the alleged owner of the assets would bring a straight forward action to "quiet title". In lay teams  a "quiet title" ruling is a declaration by a court that indeed the alleged owner owns all the assets, so any other claim to those assets is bogus.

Currently Minera Andes and Xtrata are in such a dispute on Argentinian assets with TNR, so such a "quiet title" action seems to be available under Canadian law.

YNg has not taken that action. I expect YNG has quality legal advice so there is something wrong with the assertion that YNG owns all TLG assets. Is everyone overlooking key documents ?  Where do we go to see those docs ?

HI Thanks for that.Under US law a security interest in mineral rights is perfected by enforcement through the court when the underlying secured loan is not paid. Paragraph 25 of the Petition for protection from creditors says that YSM has NOT perfected it's interest in the mineral rights that it has acquired from Mac Quarrie. YSM has been in "forebearance" even though they have not ...more

Unlike US Law in perfection has no definedstatutory or judicial meaningThe Canadian holder of "security interest" is entitled to seize & sell all property to discharge debt that security interestsecures.
