interesting article but this isn't a criminal case, it is a civil intellectual patents case you don't have trial by jury--it can only be by judge or a tribunal of experts if that is what they are meaning (as to my understanding). A jury and electing judge and jury or judge alone depends on the type of criminal offence at least in Canadian law. Like I said, this is simply corporate/civil
