My money is on the gear head aka engineer. I'm not sure about BC but in Ontario you must file a "Right to Appeal" in 60 days of the lower court judgement. The "Right to Appeal" is reviewed by 3 judges to determine its merit and lower court judgement on the case. You can not expand the scope of the case but only additional facts and prescedences.
