Wi-Lan (T.WIN) loses patent trial against Apple

It was a case of T.WIN’s P.LOSS today when Wi-Lan Inc. (TSX:T.WIN, Stock Forum) announced a Texas jury had determined U.S. Patent No RE37,802 was not infringed upon by Apple, invalidating claims made by the company in court.

Prior to the decision, six other companies (Alcatel-Lucent USA Inc., Dell Inc., Hewlett-Packard Company, HTC Corporation, Novatel Wireless, Inc. and Sierra Wireless Inc.) had settled with Wi-Lan and signed licensing agreements to avoid court. Apple (NASDAQ:AAPL, Stock Forum), however, refused to play ball and beat the case.

Wi-Lan refused comment over the case, which is still before the courts, citing company policy not to provide commentary on such cases while they are being litigated, but did say in a statement, “WiLAN is disappointed with the jury's decision and is currently reviewing its options with trial counsel, McKool Smith. WiLAN does not believe previous license agreements signed related to the patents are negatively impacted by this decision.”

Trading was halted before the announcement, and remained paused through to the trading day close. Shares sit at $4.19, having dropped 2.39% on the day before the halt.

Wi-Lan has licensing deals with 270 companies around the world, generally relating to Wi-Fi, xDSL infrastructure, and digital TV receivers.

The company owns more than 3,000 issued or pending patents.
