The TSX composite was higher, rising 57.68 points to 12,339.03 in mid-morning trading on Tuesday. The Dow was up 79.47 to 13,314.86, while NASDAQ gained 29.29 to 3,039.89.

Late Monday, Apple Inc. (NYSE: AAPL, Stock Forum) lost an important ruling when a federal judge denied its request for a permanent ban on 26 Samsung products that Apple charged -- and a jury ruled -- had willfully infringed Apple's patents. Apple shares moved up 1.29% to 525.50 in mid-morning.

The price of gold lost US$13.01 to US$1,685.18 an ounce, while silver fell US$0.178 to U$32.11 an ounce.
