Apple had filed a suit seeking sole ownership of the trademark, citing that Gradiente was launching a phone only when the trademark was nearing expiration. However, the Brazilian National Industrial Property Institute had rejected Apple's request, although it allowed Apple to use the brand for other products.

But both companies had requested the court to suspend enforcement of the ruling till the companies found a peaceful solution to the problem. Now, they are reportedly close to an agreement.

Apple is also facing another legal problem in Brazil. There has been a complaint of planned obsolescence as the fourth-generation iPad was released only months after the third-generation device.

It’s not known when the Live Tiles issue will be fixed and when the new update will be rolled out. It's also not known when non-Nokia devices can update to Windows Phone 7.8.
