First of all, up to 45k means that Canopy must buy everything Sunniva is able to produce according to specs, up to 45k. Secondly, it is not peculiar at all that the building isn't constructed yet - the agreement is only in effect starting from January 2019, in any case. If the first harvest is ready several months later, that only means Sunniva has a narrower time window to fill the maximum 45k quota for that year. Considering that 45k represents around 40% of the total annual capacity, this should be achievable even if Sunniva collects its first harvest as late as mid-2019.
