The CCAA process explained

Most readers on this board are not lawyers and many likely are somewhat vague as to how the Companies' Creditors Arrangement Act (CCAA) process works.  Here is a link to an excellent summary that explains the process.  Note the first paragraph under the heading The Restructuring Plan.  Also, "DIP" simply means "debtor-in-possession"; a DIP lender ordinarily has top priority since lending occurred after the corporation became financially distressed with a view to facilitating its reorganization.

TTT, your point is a good one.  Cases like this one are highly politicized, and the negotiations (and Ministerial statements!) reflect that.  The linked report in my original post indicates as much: During the stay period, a company will consider one or more paths towards becoming a viable going concern. Minister always come with falacious comment (maybe misunderstanding) that retails want government want them to purchase back NMX to get (for most of them) C$1/shares. This is not the point, as you mention financial are not doomsday as cry by some, and LiOH battery quality market price for sales to Tier-1 in JP/KR (NMX target market) maintains at US$14-15/kg (Joe Lowry market data). That is correct, because the industry outlook is very good.  The problem here is the huge amount of money required to develop the mine and plant.  But the economics are still good.
