some info

in reading ICSID website, i read the following:

5.3. The Tribunal will draft all rulings, including the award, within a reasonable time period. If a ruling has not been issued within three months after the final submission on a particular matter, the Tribunal will provide the Parties with status updates every two months.

I guess if we don't hear by end of day Monday, we will get updates.
Does that mean if we don't get an answer Monday, we'll get an update 2 months later?

I would think that if they don't have decision by the 3 month timeline, then I would think that it is not the slam dunk we thought!!!!!

I did read some of the materials found here: https://icsid.worldbank.org/en/Pages/cases/casedetail.aspx?CaseNo=ARB/15/29 I'm no lawyer but I don't get the impression it is the slam dunk everybody thinks it is. I'm a holder and would love for them to win but what makes everybody believe this is such a no brainer?

Why a no brainer?  The new government cancelled multiple licences around that time, allegations of bribes, a businessman killed, and in other similar situations where countries have unjustly taken away mineral rights from companies, the countries have been forced to pay bigtime.  PAW spent tens of millions on this project and followed the rules, only to have the licence taken away with ...more

Looking back at the NR's, it was in early July 2015 that PAW's cease trade order came out, and also at that time PAW initiated the tribunal process.  It would be sweet justice if a winning decision came for PAW around now, early July 2018, almost exactly three years later. So unfair that PAW put in all that work to discover and prove up this massive deposit, and Kenya just steals it ...more
