jleer42, I read once that in the fine print of the contract that you made with your brokerage firm you gave them the permission to lend out your shares at no cost to them. True?


My UnderStanding has ALWAYS BEEN that ONLY in a MARGIN Account CAN the BROKER
Lend Out YOUR Shares to a Short Seller__As You HAVE Borrowed THEIR $$$$ to Buy Shares

With a CASH Account__ALL Your Shares ARE (Must Be) FULLY PAID For__THUS the Broker
Can NOT Lend Out YOUR Shares__Much the SAME as Having a Share Certificate.

Could NOT Find My ORIGINAL Broker AGREEMENT to VERFY This.

i thought that i read the same thing but again i'm not 100% sure. As for so called "naked shorting" i have also read that it regularly occurs in Canada and we are the "laughing stock " when it comes to enforcement...WHY?? its all about the current definition - something along the lines of "best effort" must be made to settle the lending out of shares and this has ...more

Naked short selling was legal in Canada.  It is no longer legal.  I am unaware of any prosecutions.
