As for whether or not litigation would stop the distribution of onc shares.I am sure that the lawyers have already gone over this scenario and really,how can it be more equitable at this point but to distribute the onc shares to the syb shareholders.No lawsuit is going to get them anymore than that and after legal expenses most likely a lot less.
There are a lot of companies that can fail,especially in phase 3 trials,this does not necessarily have anything to do with management.We must remember that whenever you buy a stock you take a risk. (buyer beware)This can happen with almost any company,the economy takes a downturn for example.Just take a look at all of the tech stocks.
As an onc shareholder,in reality,how much more can we really expect.There are a couple of scenarios that I would have liked to have seen,but everyone has to be in agreement and it doesn't always happen.As I stated before timing may be critical in regards to this deal and do we want to really know what may happen if it doesn't go through.
Everyone of course must vote the way they feel is best for them.If you don't like the deal and think that you can get better, than vote against.It's that simple.
