Primary Symbol: PHO

The investment seeks to track the investment results (before fees and expenses) of the NASDAQ OMX US Water IndexSM (the underlying index). The fund generally will invest at least 90% of its total assets in the securities that comprise the underlying index. The underlying index seeks to track the performance of companies that create products designed to conserve and purify water for homes, businesses and industries. The underlying index may include common stocks, ordinary shares, American depositary receipts (ADRs), shares of beneficial interest and tracking stocks. The fund is non-diversified.

RE:"The defendants have yet to respond to the Claim."Given the chain of evidence presented in the PR and the conduct of the former execs, aren't length relationships etc.. I do not forsee any real issue with PHO securing the IP rights. It's a matter of removing any uncertainty and protecting shareholder interest. The defendants are all shareholders and benefit from PHO's continued success . To fight for IP rights in their position epically given the fact they did not follow the proper legal and regulatory procedures would be a waste of time and money for all parties. However, given their behavior in the past they may be foolish enough to challenge such claims . Anyone know an IP and corporate governance people to get a birds eye opinion on? This is good news in my books .. May take a while to get sorted but in the meantime growth to continue
