Primary Symbol: PHO

The investment seeks to track the investment results (before fees and expenses) of the NASDAQ OMX US Water IndexSM (the underlying index). The fund generally will invest at least 90% of its total assets in the securities that comprise the underlying index. The underlying index seeks to track the performance of companies that create products designed to conserve and purify water for homes, businesses and industries. The underlying index may include common stocks, ordinary shares, American depositary receipts (ADRs), shares of beneficial interest and tracking stocks. The fund is non-diversified.

RE:RE:Legal action Does anybody really think that Photon's customers will stick around while lawsuits are flying around the company in all directions? I don't. By all means, feel free to ignore me, it's your right to do so and I simply don't care if you do. I have a difference of opinion with Blackwood and if s/he doesn't like it, so what? It's not personal on my part. I just disagree. But initiating a shareholder lawsuit imo, is dangerous, short sighted and foolish. And at this juncture, premature. I strongly believe it would be a disaster for this company. Let the audit do its work first, release its findings, and then decide where to go from there. It'll be a while before it gets to court so exactly what's the hurry?
