RE:Globe says BlackBerry to sell most of 38,000 patents.My guess would be that Blackberry has already tried to do what Wilan does--shopped the best of their patents to the super lawyers to see if they would be willing to move them forward on a contingency basis.
And if Blackberry is now putting their patents up for sale then I would take that to mean that the super lawyers weren't interested.
I suspect one could think in terms of two levels of patent quality (among patents that have any value at all).
The very best can be used for offense. You go after the big-money infringers and not only can infringement be demonstrated but the patent is able to withstand the inevitable waves of IPR attacks.
The second level patents, I would think, are not such a great bet as offensive "weapons" but they may still have value in a defensive way. Google says to Microsoft, in effect, if you sue us with Patent X we will turn around and sue you with Patent Y.
While such purely defensive patents might be of some value to a tech behemoth, I would think they would be of no value to Wilan, which is in the "offense" business, patent-wise.
I will be surprised if Wilan buys any of the Blackberry patents. I will not be surprised if some tech behemoth buys the Blackberry patents.
