After mulling the oral argument over for a bit, there is only one issue of substance: damages. The court had much interest in apportionment and the fact that comparable licenses were portolio licenses, not specifically to the asserted 145/757 patents.  I thought Lamken argued common sense that the 145/757 patents were what made the VoIP feature in iPhones work.  A corollary to ...more

So, what kind of outcomes would be options for the judges decisions? Can they order a 3rd trial (which can be appealed all over again)? Can they take it upon themselves to set a damages amount and then order Apple to pay? Not sure what we're dealing with here as far as their decision making power.

Cactus, they can remand for a 3rd trial and/or they can set the rate. On several occasions the court said they do not want a 3rd trial. So they will set the rate if Wilan and Apple cannot settle. However, this not their first choice; they said as much. A settlement is the court's preferred option. Thanks Cabbie. I love how passionate about this company some of us are that they've went out and  acquired an excellent understanding of the justice system! So, if the the judges do end up setting the rate, is that it? Case closed?

If we assume the court with set the rate... what is the range we are looking at? (say parameters are .45 to .85 for damages, with/without additional Iphones)

We don't know what rate the court might set if it get to the point they set the rate. Realistically, it would fall between 45 and 85 cents per unit although the low end of the range could be Apple's number (that could be the $10M remittittur or a reported 25 cents Apple offered in mediation). That said, the court is strongly suggesting a settlement.

You are 100% right Cabbie.   Before the argument today, there was a probability that the court could have restated the claims construction setting this case back to square one.  The judges dimmissed the validity and infringement arguments, appearing to side with the district court. The only issue was with respect to damages.  They can agree to the first jury trial the second ...more

I don't see any analyst commenting.  They never did on the prior run ups on potential legal outcomes.  All they do is impute numbers into a spreadsheet to catch up to where the price action is.   Technicals were not impaired today.  They remain intact.  The golden cross, the upward and positively sloping moving averages remain.  In fact, The CMF indicator has ...more
