Question?

I have no legal  or court procedure and have questions..
 
Can CAFC  give the parties until a certain date to present settlement before they give decision.??

Can  Both parties advise the court to defer  decision until certain date before make their decision.??

I'm pretty sure the first would never happen. Not to say courts don't try to push parties to settle--indeed the CAFC sort of did that in the Apple hearing. But to hold back a decision with the idea that the parties might settle by a chosen date? It would sort of look like a weird kind of begging the parties to settle. The second does happen for sure. mrmoribund is right. I think that has happened with a trigger date this month and may be behind Kidd's comment, that Apple should be resolved in short order. I'll check the Needham replay tomorrow to determine if my ear and recollection is correct.

Kidd's high level comment on Wilan was in the ATB presentation.  As a lead in for John Rim to answer a moderator question on Wilan, Kidd provided this 30,000 ft. view. You don't launch a second strategic review of WiLan unless you are sure of its success.  And go through a major restructuring.   Gilberry isn't going to give up his 500k options on a possibility.  If he is ousted he loses them all.   Apple is resolved.  We will learn soon enough.  Then WiLan will be sold.

Hence even more of a reason as to why if it doesn't lead to a transaction Gilberry is out.   No one would put 500k options that they took 10 years to accumulate (taking no cash as board fees) on the line for a possibility.

As I've posted previously, my sense is that QTRH and Apple are negotiating a comprehensive deal. So yes, I believe as v_g does, that there is a line of sight on this deal and that supported both the strategic review and reorganization. A line of sight on Apple establishes the value of Wilan. While I doubt a Wilan deal is in hand, the BoD surely has a very good read on interest. The ducks are ...more
