the deb are not getting much and therfor it should be in recievership. the buyer should just walk and buy it out of recievership, they will save a bundle. shareholders will get nothing and debentures will get nothing ( more than likely)..
Spartan could have bought kinwest before CCAA but decided to let it go and get it a bit cheaper than Bank debt, plus no money for the unsecured..
