in our case we have a Supreme Court ruling in our favor that we had adequately dealt with first nations with a signed memmoradum of understand with lbn which they didn't honor also judge said we had done everything required to get get our eac. So really these Supreme Court decisions are they really binding? In our case doesn't seem like it but maybe in this case they will pay attention to the ruling but who knows what it really means.
