The International Exhorto for John Thornton was issued on December 15. 2022 by the Supreme Court, Case No. 147691-2022, in the proceedings against Ossa and Claro by MSX/BJ, C 2418-2021.

"In view of the merits of the record, the information provided by the Judicial Prosecutor’s Office, and the provisions of Article 76 of the Code of Civil Procedure, we proceed with the present exhorto and send these records to the Ministry of Foreign Affairs for sending it to Canada."

So are there any dates indicated for an appearance via ZOOM and what does it all mean? Who needs to find Thornton ? Which level of court in Canada is handling this ? Who is responsible for the questions ? Just curious !

I would expect to see this lawsuit C 2418-2021 withdrawn from the court in Chile. After all...there is no more MSX to sue Ossa/ Claro, which is what Thornton is to be deposed on. As for the Exhorto being issued Dec. 15th from the Chilean Supreme Court...one can assume the left hand hasn't caught up with the right hand yet. Why would BJ want to continue to finance this fiasco?  Where

MSX stills exists just not traded publicly . The players will all take this action to their graves either through natural aging events or by other intended deaths through naferious actions..When you get thirteen year old girls murdering openly on city streets by stabbings as a group for thrills.......................anything can happen. I still contend Chile has intent herein !

You are really splitting hairs as far as MSX goes Uglu! What constitutes a company in your mind? In this case MSX has been permanently delisted, BJ has been sanctioned and fined and can't hold any position in a public company again. MSX has no revenue and no assets...just unpaid debt. The exhorto needs to be sent to Canada, delivered to the Court (I assume a civil court will take care of the deposition), and a date set up for Mr. Thornton to testify.  The testimony will be in the Canadian court and not by Zoom.  The questions have been sent with the exhorto and will be asked at the deposition by a lawyer of the plaintiff's choosing.  I am assuming that JT

Would the court in Vancouver have an open forum for an audience of some sort or would it be a closed session normally ? Is this requested testimony from Chile something that could be mentioned on the public forums as it involves Barrick in what could "eventually" be a serious situation. Chile should be tied in to the testimony live IMO. Is there a need to advise ABX shareholders or is

No, to all of your questions. The exhorto is for John Thornton so the court will be in Toronto, not Vancouver. The testimony is for C 2418-2021, which is the lawsuit against Ossa and Claro & Co. filed by MSX and BJ.  Barrick is not a party to this lawsuit.  Nothing needs to be disclosed as there is absolutely no liability to Barrick, let alone anything "serious".
