Oral vs written arguments

When the court decides on a case, they have to consider everything that was gathered, which includes oral and written arguments.

The oral arguments don't necessarily count more than the written arguments.

Even if Wilan didn't argue orally that they think the original damages should be re-instated, it is still on record in the case.

|My honest take is that we are OK on claims construction - Just because Lamkin states you can't properly use a cell phone without these patents doesn't mean its true but I'm assuming the court docs explain and back up this assertion with facts and expert testimony. However, we weren't convincing on damages.  Unless there is some other way to put a value on the patents in the

I had 780k shares... and I just bought 3k more with the dividend.  Now 783k shares. This hearing essentially eliminated the risk of patent invalidated or appple escaping infringement. It is now just how much money at stake.  The judges couldn't have been any clearer on that.   I believe this increases the odds of a settlement as Apple's attempt to get the patent

Chi, the market saw neither a win nor a loss.  A win is not factored into QTRH's stock price and that is why it is not moving.  The first of 3 patent trials against Apple goes on 24-Oct-2021.  Keep an eye on this.  German courts are effecient and a ruling typically takes about a month.  The second patent trial is in November and the third is in Q1.  These are

Has anyone downloaded the written arguments from PACER yet and is willing to share? Seems a shame to have everyone continue to pay for access to public court filings.

My take is that judge wants to give Apple a chance to settle at lesser amount than cross-appeal amount  of .85 cents.   If no settlement we may get original amount as Judges did not want to discuss cross-appeal. Cross-appeal talked for itself..
