Oral vs written arguments
When the court decides on a case, they have to consider everything that was gathered, which includes oral and written arguments.
The oral arguments don't necessarily count more than the written arguments.
Even if Wilan didn't argue orally that they think the original damages should be re-instated, it is still on record in the case.

Oh, and full disclosure. I sold a big chunk of my holdings (less than half though) and as of 1pm that accounted for over half of today's volume. So, the market doesn't seem to agree with my assessment. Chi

Has anyone downloaded the written arguments from PACER yet and is willing to share? Seems a shame to have everyone continue to pay for access to public court filings.

My take is that judge wants to give Apple a chance to settle at lesser amount than cross-appeal amount of .85 cents. If no settlement we may get original amount as Judges did not want to discuss cross-appeal. Cross-appeal talked for itself..
