Yes, you can. Reach the Affidavit of Brittany Davison sworn on September 22 at the FTI page. The court has to take a decision about it -it will probably release the D&O.

I personally was invested in the Canadian ticker for this so the CSA would be the relevant body here (though unlike the SEC, I've quite literally never heard of the CSA doing anything before)

I don't think anything is going to be done since none of us are willing to shell out the time/money needed for a lawyer or pursuing legal action. There doesn't seem to be a class-action suit ...more
