Are you really suggesting that tailings be transported uphill (and that isn't as easy as you think it is in this particular case) to an adjacent claim. It will never happen.
Besides, Salta has already proved that the adjacent deposit is better quality than that in Lumina's claims.
If there was any truth in your creative suggestion wouldn't the government allow Salta to dump their tailings on Lumina's claim? Salta doesn't even have to transport the tailings. All they have to do is push them over the side or when it rains or snows let nature do that for them.
Besides neither Lumina or Salta will be dumping tailings on anybody. Neither are mining companies. They are both exploration companies. They aren't interested in setting up mines. But in order for Lumina to sell its claims there must at least be a reasonable chance that mining operations can be built there. The only way that is happening is with a JV.
